Occupancy Permits for Residential Projects

Secure the final certification to safely and legally inhabit your new residential building. We provide expert compliance oversight for homeowners and builders across Victoria.

Do I need council approval?

An occupancy permit is required for any project where building work creates a new space or changes the use of an existing one. In Victoria, you cannot legally occupy a new home or building until a building surveyor has issued this permit, verifying that the structure is safe for habitation and meets all legal requirements.

I’m an Owner-Builder

If you have managed the construction of your own home, obtaining an Occupancy Permit is the final legal requirement before moving in. This certificate verifies that your project meets Victorian safety and structural compliance standards.

Occupancy Permit Compliance

How much does it cost?

The fees for residential occupancy permits are calculated based on project scale, complexity, and specific council requirements. We offer competitive, itemized quotes tailored to your build.

How long does approval take?

Most residential occupancy permits are finalized within 7–14 days of a successful final inspection, provided all necessary compliance certificates from trades are verified.

Issues if occupied without a permit

Occupation without a valid permit is a breach of the Building Act. It creates safety risks for occupants, invalidates insurance, and can result in significant council fines.

FAQs & Required Documents

What is the difference between an Occupancy Permit and a Final Certificate?

An Occupancy Permit is required for all new homes and buildings to ensure they are safe for habitation. A Certificate of Final Inspection is issued for extensions, renovations, or minor alterations to existing dwellings where a full occupancy permit isn't applicable.

Can I move into my new home before the Occupancy Permit is issued?

No. Under the Building Act, it is an offence to occupy a new building without a valid Occupancy Permit. Doing so can result in significant fines and may void your insurance coverage.

Who is responsible for issuing the Occupancy Permit?

Your appointed Relevant Building Surveyor (RBS) issues the permit. They must be satisfied that the building is structurally sound and that all statutory compliance documents have been provided.

Commonly Required Documents for Approval

  • Final Plumbing Certificate of Compliance
  • Electrical Safety Certificate
  • Bushfire Attack Level (BAL) Compliance Statement (if applicable)
  • Termite Protection Certificates
  • Glazing and Energy Rating Compliance Reports
  • Structural Engineering Final Certificates
